Terms of Service

These terms cover your use of 5wdigitalco.com and any services you buy from 5W Digital Co. By using the site or buying a service, you agree to these terms. If you have signed a separate Client Service Agreement with us, that agreement controls wherever the two conflict.

1. Services and prices

Current services and prices (also listed at Services):

Get Found Bundle: $799 setup + $249/month (website build, Google Business Profile setup, monthly GBP management, and Site Care)
Google Business Profile Setup: $349 one time, or $99 when added to Monthly GBP Management
Monthly GBP Management: $199/month. Founding Client rate: your $199 price will not go up for 12 months from your start date. This is a price lock, not a commitment. You can still cancel anytime.
Monthly GBP + Local SEO: $399/month
Business Website Build: $599 one time, plus required Site Care at $59/month (hosting, SSL, backups, and up to 2 small updates a month)

Google Business Profile is free from Google. Anyone can create and manage a profile at no cost from Google. Our fees pay for our setup and management work, not for anything charged by Google. Working with a third party (opens in a new tab)

Prices do not include any sales tax that may apply. Price changes never affect a payment you have already made. Existing monthly clients get at least 30 days’ written notice before a price change applies to their plan, and they can cancel before it does.

2. Payment, all sales final, and automatic renewal

Payment is up front through Stripe checkout.
Work starts when payment is received. All sales are final. We do not refund setup, build, or monthly fees once payment is received, except for a clear billing mistake (duplicate charge or a charge after you canceled). See our Refund & Cancellation Policy.
Monthly plans renew automatically every month on the same date, and your card is charged until you cancel. We show the monthly amount before you pay.
If a payment fails, we will tell you, and Stripe may retry. We may pause work after 14 days past due. We do not charge late fees or interest. A pause never affects your ownership of your Google Business Profile or domain.

3. No long-term contract; how to cancel

Monthly plans are month to month. Cancel anytime by emailing darren@5wdigitalco.com, or through Stripe if the customer portal is available.
Cancellation stops future charges. Service continues through the end of the period you have paid for. We do not charge cancellation fees. No partial-period refunds.

4. Timelines and what we need from you

Website builds, GBP Setup, and the Get Found Bundle go live within 5 to 7 business days after we receive your content and access. The clock starts once both arrive.
Website builds include 2 rounds of revisions. A third round is quoted before any work, case by case. GBP Setup includes 1 round. You have 5 business days to review each preview.
Google controls verification. If Google requires extra steps, the timeline depends on Google.

5. What we do not promise

We work to improve how your business shows up on Google. We do not control Google, and we cannot guarantee rankings, a top placement, calls, leads, reviews, or revenue. Google can change its rules, suspend listings, or require re-verification at any time.

6. Your responsibilities

The information and content you give us must be accurate, and you must have the right to use it (photos, logos, licenses).
You are responsible for the rules that apply to your trade, such as licensing and advertising rules.
Never send us passwords. We will ask for invite-based access instead.

7. Ownership

You always own your business name, logo, photos, content, Google Business Profile, and domain. We never hold a Google Business Profile or domain back, including over an unpaid bill. When you ask, we remove our access within 7 business days.
Website: once your setup fee is paid in full, you own the final site design and content we delivered. Hosting under Site Care is a service. On request, we send the site files within 10 business days so you can host anywhere. Our reusable tools and templates stay ours, and you receive a permanent license to use them as part of your site.
We may show your project in our portfolio unless you tell us in writing not to.

8. Acceptable use of the website

Do not misuse the site: no spam form submissions, scraping, attempts to break in, or unlawful use.

9. Limits on liability

To the extent the law allows, 5W’s total liability for any claim related to the services is limited to what you paid 5W in the 3 months before the claim. To the same extent, neither of us is liable to the other for indirect or consequential losses such as lost profits. These limits do not apply where the law does not allow them, and nothing in these terms waives or limits any right you have under the Texas Deceptive Trade Practices–Consumer Protection Act or any other law that cannot be waived.

10. Problems and disputes

If something goes wrong, email darren@5wdigitalco.com first, and we will try in good faith to fix it within 30 days. If we cannot resolve it, either of us may ask for mediation in Guadalupe County, Texas, with costs shared equally, before filing a lawsuit. Either of us can still use small-claims (justice) court. Texas law governs these terms. Any lawsuit must be filed in the state courts of Guadalupe County, Texas, unless the law requires a different venue.

11. Changes to these terms

We may update these terms. The effective date shows the latest version. Changes do not apply retroactively to a payment you have already made.
